Halo rip-off

If Apple cares so much about intellectual property, how come this Halo rip-off was accepted on the app store?
This developer is known for creating iOs versions stylized after of popular franchises like Halo or Call of Duty. Technically those games are stunning, but I would like if their could come up with their own ideas...
